CANCELLATION POLICY:
Whenever possible please give me 48 hours notice if you need to cancel. If notice of cancellation (regardless of the reason) is not given by 10:00AM THE DAY BEFORE YOUR SCHEDULED LESSON you are required to pay for that time. Notice must be given by email at ben@toptierbaseball.com or bdjohnstone25@yahoo.com AND by either text or voicemail at 678-612-4754. If you miss the 10:00AM cut-off, you do have the option of selling or giving your time slot to another family in order to fill your time, so please make any attempt that you can to do so. In any cases where another family is going to fill your time please have them contact me by email or phone prior to the lesson. If they do not contact me it is understood that they agree to all policies, waivers, and consent included in this email.
If for some reason I miss a session due to conflict or airheadedness (it happens!) I will make that session up with you at half price. In the interest of everyone’s health and safety I reserve the right to cancel sessions at any point due to my being ill or injured.
Lessons are not considered canceled unless confirmed by me in person, by phone 678-612-4754, or by email ben@toptierbaseball.com. In any case in which confirmation is not granted lessons are considered to be on and the cancellation policies apply.
RAIN / BAD WEATHER / QUESTIONABLE CONDITIONS / LATE ARRIVAL:
Generally lessons will only be canceled due to extreme cold, heavy rain, and/or lightning. If you are at all unsure of the status of a lesson, please call 678-612-4754 to see if we are on or off. If you can not reach me by phone, please show up at the time and location that we are scheduled for. Lessons canceled due to inclement weather may be rescheduled at no cost.
Occasionally there are circumstances that cause me to be late. If you have any question of whether or not I will be there please call me at 678-612-4754. I may be just around the corner! If you leave before calling to see if I will be there you must cover the time for which you were scheduled.
Occasionally there are circumstances that cause me to get off schedule and to run behind. In these situations I will make that time up to you at the end of the session when possible, or I will add it onto a future session when extending that day’s session is not possible.

PRE-PAID CREDIT REMAINING POLICY:
Any unused paid credit remaining for 3 or more months will become subject to any price increases as they occur. In cases where a package of lessons was purchased the credit remaining will be debited the current amount of the lesson value. Families are encouraged to schedule lessons in advance upon purchase of lesson packages. Credit unused for 6 months will be considered forfeited to Top Tier Baseball, LLC.
AUCTION LESSONS:
Purchasers of auction lessons must contact Ben Johnstone at bdjohnstone25@yahoo.com within one week of purchase and must use those lessons within 3 months of purchase or during the dates either specified on the auction certificate or communicated by Ben Johnstone.. Lessons are subject to availability.
PARENTAL WAIVER AND CONSENT:
By scheduling your child and any other children to participate in any manner in practices with Top Tier Baseball, LLC, you and the parents or legal guardians of those other children agree to the following waiver and consent statement:
As the parent or legal guardian of the child or children practicing with Top Tier Baseball, LLC.. I hereby give my full consent and approval for my child to participate in the sports practices. I understand that there are certain risks of injury inherent in the practice and play of this sport, as well as in traveling and other related activities incidental to my child’s participation, and I am willing to assume these risks on behalf of my child. I hereby certify that my child is fully capable of participating in the practiced sport and that my child is healthy and has no physical or mental disabilities or infirmities that would restrict full participation in these activities, except as communicated in writing to Top Tier Baseball, LLC. In addition to giving my full consent for my child’s participation, I do hereby waive, release and hold harmless Top Tier Baseball, LLC, Ben Johnstone, any assistants of Top Tier Baseball, LLC, and the owners of or those responsible for the facilities at which practices are conducted for any injury that may be suffered by my child in the normal course of participation in the designated sport and the activities incidental thereto, whether the result of negligence or any other cause. Should I, or any other parent, guardian, adult, or child choose to participate in my child’s scheduled practice I do hereby waive, release and hold harmless Top Tier Baseball, LLC, Ben Johnstone, any assistants of Top Tier Baseball, LLC, and the owners of or those responsible for the facilities at which practices are conducted for any injury that may be suffered by me or any other participants in the normal course of participation in the designated sport and the activities incidental thereto, whether the result of negligence or any other cause.
